The United States District Court denied SerpApi's request to dismiss Reddit's lawsuit. According to the ruling by Judge Paul Engelmayer, Reddit has provided sufficient evidence to claim a conspiracy between SerpApi and Perplexity AI to bypass Google's access controls and illegally scrape content.
This decision comes after Google recently lost a similar case, as it failed to prove that copyright holders had authorized Google to prevent content scraping. However, the current court believes there is a possibility of cooperation between the tool provider and the end-user (Perplexity) to violate the laws. In contrast, SerpApi claims that Reddit and Google are abusing the Digital Millennium Copyright Act (DMCA) to monopolize the open internet and control content they do not actually own.
